Two men who have had court dates scheduled and rescheduled will see another delay after facing Boyle County Circuit Court Judge Darren Peckler on Tuesday.

Marion Fisher and Jerry Mathes will both be in court again on April 4, ideally to set trial dates in their respective cases, said Commonwealth’s Attorney Richie Bottoms.

Fisher is accused of unlawful imprisonment of Sharonna Harmon, who he was dating at the time, on July 23, 2015. The two had been drinking, according to an Aug. 6, 2015, article in The Advocate-Messenger, and the ride ultimately ended in a police foot pursuit in Mercer County.

Fisher is charged with first-degree fleeing or evading police; driving under the influence of drugs, second offense; driving on a suspended license; third-degree possession of a controlled substance; first-degree resisting arrest; first-degree unlawful imprisonment; first-degree wanton endangerment; two counts of first-degree wanton endangerment for a police officer; and driving on a suspended or revoked license.

A trial for Fisher was supposed to start last week, but was delayed. William Butler, Fisher’s attorney, said he needed more time to prepare — he had only taken the case over sometime in February. Prior to that, Fisher was being represented by a public defender.

Mathes is accused in an altercation involving a handgun in 2014. 

According to archives from The Advocate-Messenger, Danville Police officers were called to Jerry’s Body Shop at about 11 p.m. Oct. 24, 2014. Mathes and Ricky Cole, a customer at the time, were allegedly engaged in a fight. Cole had suffered a gun shot wound.

Mathes faces charges of assault; possession of cocaine; and possession of drug 

paraphernalia.

In January 2017, Mathes was expected to enter a plea deal, but instead asked for a trial to be held.
