A Harrodsburg couple is suing the Kentucky Lottery Corporation for $1,125,000, alleging that the corporation is in breach of contract for refusing to pay winnings from Cash Ball tickets they purchased.

According to the lawsuit filed in the Mercer County Circuit Court on Sept. 6, Tom Wooten purchased five tickets from a Shell station in Harrodsburg on Feb. 25. 

“On or about Feb. 25, 2017, the plaintiffs checked their tickets online and saw that they had the winning numbers on their five tickets,” according to the suit.

When Tom and his wife Linda, of 3356 Shakertown Road in Harrodsburg, attempted to collect their winnings, they were told the numbers they had were incorrectly posted.

The incorrect posting, the suit alleges, “is a pattern of ongoing negligent incompetence.”

Kentucky Cash Ball is drawn every day, according to the Kentucky Lottery website.

On May 29, the lawsuit states, the Pick 3 and Pick 4 numbers displayed online were not the same as the ones aired on WKYT. Again, on June 8, the Pick 3 numbers online and aired on the television were not the same, the suit alleges.

The Pick 3 and Pick 4 are each drawn twice a day, according to the Kentucky Lottery website.

The winnings of the five tickets would have been $1,125,000, according to the lawsuit, which is what the Wootens are suing for, in addition to punitive damages and attorney’s fees. The Wootons are being represented by Helton, Walter and Associates.
