An 18-year-old Boyle County High School student was charged after threatening to kill a judge during a threat assessment in connection with another case.

Ashton R. Smith, of Persimmon Knob Road in Junction City, allegedly made the threat and was arrested on Sept. 25. He has been charged with intimidating a participant in a legal process, according to the police citation.

The complaint stated that during the threat assessment, Smith said if he was charged with a felony at his Nov. 5 court date, he would “attack the judge and beat him until they kill him.”

The citation said Smith denied threatening anyone except himself. Police arrested Smith at his residence and he was taken to the Boyle County Detention Center, where he was released after a $25,000 bond was posted.

At the time of his arrest, Smith also had charges pending related to an incident at the high school that occurred on Sept. 12, according to police.

A witness at the school stated that while Smith was in a classroom with students and faculty, he commented to a teacher, “You’re a dumbass,” and made comments which upset other students and made them nervous, according to police records.

Smith told one of the teachers to not come to school the next day, then made a gun hand-gesture and firing sound.

After being read his Miranda rights, Smith agreed to answer police questions and admitted to making the comment and hand gesture “but that it was a joke,” according to the citation.

Other witnesses confirmed Smith’s comments and actions and he was arrested on charges of second-degree terroristic threatening; abuse of a teacher; harassment; and second-degree disorderly conduct. He was taken to the Boyle jail, where he was later released on a $2,000 bond.

Smith is scheduled to appear in court to face these charges, along with the most recent, intimidating a participant in a legal process, at 9 a.m. Nov. 5.
